Fastex Peer-to-Peer (P2P) Terms of Use

By subscribing to Fastex Peer-to-Peer, available at exchange.fastex.com/p2p or any other URL designated by Fastex from time to time, including mobile applications and related services ("Fastex P2P"), you acknowledge that you have read, understood, and agreed to be bound by these Peer-to-Peer Product Terms ("P2P Terms"). If you do not fully understand or accept these P2P Terms, you must not subscribe.

B. Definitions

“Advertiser” refers to a user who publishes an Advertisement. An Advertiser may also be referred to as a “Maker.”

“Advertisement” means an offer published on Fastex P2P specifying the amount of Digital Assets available for trade, the price, payment method, Order Limit, Payment Duration, and other applicable terms set by the Advertiser.

“Buyer” refers to a user trading on Fastex P2P to purchase Digital Assets, either as an Advertiser or a Taker.

“Cash Merchant” has the meaning given in Clause 14.

“Order” refers to a binding trade agreement on Fastex P2P between an Advertiser and a Taker based on an Advertisement’s terms.

“Order Limit” specifies the minimum and maximum amount of Digital Assets or Fiat Currency that a Taker can trade in a single Order.

“Payment Duration” is the time period set by the Advertiser within which the Buyer must transfer the Fiat Currency in exchange for Digital Assets.

“Seller” refers to a user trading on Fastex P2P to sell Digital Assets, either as an Advertiser or a Taker.

“Taker” is a user who places an Order in response to an Advertisement published by an Advertiser.

“Third-Party Content” has the meaning given in Clause 22.

“Transfer Fees” are the fees imposed by the payment service provider for transferring Fiat Currency between the Buyer and the Seller.

C. Overview of Fastex P2P

  1. 1. Fastex P2P is a platform facilitating direct Digital Asset trades between users. You may act as an Advertiser or a Taker to buy or sell Digital Assets. a. As an Advertiser, you may have up to two active buy and two active sell offers for the same fiat-crypto pair. An Advertisement must include the amount, price, Order Limit, Payment Duration, and applicable terms. Fastex may charge Advertiser fees, which may be adjusted at its sole discretion.
  2. 2. Users may participate as Buyers or Sellers, regardless of whether they are Advertisers or Takers.
  3. 3. Fastex may impose eligibility requirements for publishing Advertisements, which may change at its discretion.
  4. 4. Placing an Order constitutes acceptance of the Advertisement’s terms, creating a binding trade agreement. Fastex locks the traded Digital Assets until the Fiat Currency transfer is confirmed by both parties. Locked Digital Assets remain unavailable unless the Order is canceled or released upon confirmation of payment.
  5. 5. Fastex is not a party to any transactions conducted on Fastex P2P. Advertisers independently set trade terms, including amount, price, payment method, Order Limit, and Payment Duration. Fastex only facilitates transactions as described in Clause 4.

D. Choice of Payment Method

  1. 6. Fastex P2P displays available payment methods, but Fastex does not endorse, verify, or maintain relationships with any listed payment providers.
  2. 7. Advertisers must select one or more payment methods from the available options. Takers must use one of the payment methods designated by the Advertiser.
  3. 8. Users must ensure that their payment method account name matches the verified name on their Fastex Account. Exceptions may be granted with an Authorization form and valid identification, subject to Fastex’s approval. Fastex reserves the right to suspend or terminate access if a mismatched payment account is used without proper authorization.
  4. 9. By placing an Order, you authorize Fastex to share your verified name with the counterparty.
  5. 10. Buyers must complete payment within the specified Payment Duration and confirm the transfer. Repeatedly canceling Orders or failing to complete transactions may result in restrictions.
  6. 11. Sellers are responsible for verifying the Buyer’s payment before confirming the release of Digital Assets. Digital Assets should only be released once full payment is received. Transactions are final unless otherwise required by law.
  7. 12. Buyers bear all Transfer Fees unless otherwise agreed. If Transfer Fees apply to the Seller, the Seller must disclose them in the Advertisement or notify the Buyer in advance.
  8. 13. Cash payments may be permitted based on location and trade value. Users engaging in cash transactions assume all associated risks. Fastex is not liable for losses resulting from security risks such as theft or fraud.

E. T+1 / T+2 Withdrawal Waiting Period

  1. 14. Fastex may impose a 24- to 48-hour withdrawal waiting period for Digital Assets purchased using certain Fiat Currencies.

F. Appeal Procedure

  1. 15. Fastex does not resolve disputes between Buyers and Sellers and bears no liability for payment-related losses.
  2. 16. If parties cannot resolve a dispute through Fastex’s Chat Service, they may file an appeal. The appeal process serves only as a mediation tool and does not guarantee resolution.
  3. 17. Users failing to cooperate during the appeal process or submitting falsified evidence may face suspension.
  4. Fastex does not facilitate private trades and assumes no liability for transactions conducted outside its platform.
  5. Fastex reserves final authority over appeal resolutions and may reopen cases at its discretion.

G. Ratings, Usernames, and Communications

  1. Users may rate and review trading counterparts. Poor ratings may result in access restrictions.
  2. Usernames must not contain “Fastex,” names of financial institutions, or inappropriate terms.
  3. Sharing personal contact details or advertisements through the Chat Service is prohibited. Chats may be monitored, and misuse may result in suspension.
  4. Offensive, inappropriate, or abusive language in chat is strictly prohibited and may lead to account suspension.
  5. Fastex does not endorse or control Third-Party Content linked through the platform and assumes no liability for any resulting interactions.

H. Suspicious Trading Behavior

  1. Fastex may suspend or terminate access without prior notice for risk management or legal compliance reasons.
  2. Suspended access may be reinstated at Fastex’s discretion.
  3. Fastex may disclose user details to regulatory authorities if unlawful activity is suspected.

I. Risk Disclosure

  1. Digital Asset prices are volatile. Fastex bears no responsibility for losses resulting from market fluctuations.
  2. Fastex reserves the right to claw back or reverse erroneously transferred assets at its discretion, subject to applicable laws.

J. Miscellaneous

  1. Terms undefined herein shall have the meanings set forth in the Fastex Terms of Use ("Terms of Use").

In case of conflict between these P2P Terms and the Terms of Use, these P2P Terms shall take precedence.
